You generally need the FSSAI registration or licence appropriate to your actual food activity before selling homemade food. You may also need state or municipal permission for using the home premises, Shops and Establishments registration, GST registration, Legal Metrology declarations for packaged food, trademark protection, packaging compliance and delivery-platform documents. The correct list depends on what you make, how it is packed, where it is prepared, who delivers it and whether you sell through your own channels or an e-commerce food platform.

A homemade cake sold through WhatsApp, a bottled pickle dispatched by courier and a cooked meal delivered through an application are not the same legal model. The first step is to define the product, shelf life, packaging, premises, delivery radius and order flow.

1. FSSAI registration or licence

A food business operator generally needs the FSSAI registration or licence appropriate to the business. Use FoSCoS to map every activity and premises. Turnover may be relevant, but it is not the only eligibility factor.

2. Can the home kitchen be used?

Using a home address for correspondence is different from conducting food preparation, bulk storage, worker activity and delivery dispatch from the premises. Check whether the scale and nature of the operation are compatible with the location.

4. GST registration

FSSAI and GST are separate. FSSAI addresses food-business and safety regulation. GST applies to indirect tax.
