Practical answer

Every food business operator must determine whether it needs basic registration, a State licence or a Central licence under the FSS framework. The decision depends on the Kind of Business, turnover, capacity, product and special categories—not on a copied list of businesses or a claimed universal exemption.

What FSSAI is

FSSAI is the statutory authority established under the Food Safety and Standards Act, 2006. It develops standards and coordinates food-safety regulation with Central and State authorities. Its headquarters and regional structure can change, so an evergreen guide should link to the official contact directory rather than hard-code office counts.

How India's food law evolved

The FSS Act consolidated multiple central food orders and the Prevention of Food Adulteration framework into one modern system. The Essential Commodities Act remains a separate law for control of specified commodities. Historical context is useful, but the Bengal famine is not a legal source for current licensing duties.

Who is a food business operator

Manufacturers, processors, repackers, relabellers, storage operators, transporters, wholesalers, distributors, retailers, restaurants, caterers, cloud kitchens, e-commerce food businesses and importers can be FBOs. The exact activity and premise determine authorisation; cosmetics are not food and should not appear in a generic food-retailer list.

How to apply through FoSCoS

  1. Map each premise, product and food activity.
  2. Use FoSCoS eligibility to select the Kind of Business.
  3. Prepare identity, premises, layout, equipment, water and food-safety documents as applicable.
  4. File the application and pay the prescribed fee.
  5. Respond to scrutiny or inspection requirements.
  6. Display the authorisation and comply with licence conditions.

Number, display and labelling

FSSAI registration/licence numbers contain 14 digits and must be displayed or declared in the prescribed manner. Packaging must separately meet the Labelling and Display Regulations and other product standards. A number on a label does not prove that every claim or ingredient is compliant.

Duties after approval

Maintain hygiene, trained supervision, traceability, testing and recall readiness; source from authorised suppliers; file returns where applicable; renew or modify before relevant deadlines; and report changes in premise, products, capacity or constitution. Sector-specific standards may impose additional duties.

Initiatives and public programmes

FSSAI initiatives include Eat Right India, State Food Safety Index, Eat Right Station and programmes addressing trans fat and food-safety capacity. Programme names, partners and targets evolve; consult official programme pages for current status rather than presenting past campaign goals as present deadlines.

Exemptions and myths

The supplied exemption list for home-group members, direct sellers, milk sellers, couriers and vending-machine owners is unsafe as a universal rule. Exemptions and responsibility allocations are fact-specific and notification-based. Home food businesses and small carts often require basic registration rather than no authorisation.

Common mistakes

  • Using Wikipedia as the primary legal source.
  • Selecting solely by turnover.
  • Assuming home-based means exempt.
  • Using one licence for unrelated premises.
  • Ignoring labels, claims and product standards.
  • Failing to modify or renew after business changes.

Frequently asked questions

Does every food business need a Central licence?

No. The correct outcome may be basic registration, State licence or Central licence.

Are home food businesses exempt?

Not automatically. Many must obtain registration or a licence depending on their facts.

Is an FSSAI number a product-quality certificate?

No. It identifies regulatory authorisation and does not endorse every product or claim.

Where should eligibility be checked?

Use FoSCoS and the current licensing regulations and notifications.
